Removal of Trustees
If, as a beneficiary, you are not happy with the way that the trustees are handling the trust, you can apply eventually to the Court, for firstly an Account and enquiry and then if needed, make an application for the removal of the trustee or executor. The application for removal needs to be well founded, and the Courts will be slow to remove a trustee or executor. The Court does have the power to do that, in certain circumstances. We can advise you on the circumstances and the best way to approach this.
If you are a Trustee, faced with a challenge, we can assess that with you. We can advice as to your position, and assess whether the costs of defending are covered by the Trust funds.
